Please read these Terms carefully

By creating an account, downloading or using the Marker North Client, connecting through CAPS, or otherwise accessing Marker North, you agree to these Terms of Service and the Marker North Privacy Policy.

1. Agreement to These Terms

These Terms of Service (the “Terms”) form a binding agreement between you and Marker North regarding your access to and use of the Marker North website, driver portal, desktop client, Connected Autonomous Platform System (“CAPS”), telemetry services, maps, APIs, community features, reports, exports, and related services (collectively, the “Service”).

If you do not agree to these Terms or the Privacy Policy, do not create an account, install the Marker North Client, connect CAPS, or use the Service.

2. Eligibility and Adult Accounts

You must be at least 18 years old to create or use a Marker North account. By registering, you represent and warrant that you are at least 18 years old and legally capable of entering into these Terms.

Marker North does not request your birthdate or birth year during ordinary registration. Instead, registration requires you to affirm that you are at least 18 years old. Providing false eligibility or age information is a violation of these Terms and may result in account suspension or termination.

If Marker North reasonably believes an account belongs to someone under 18, it may restrict or suspend the account while reviewing the matter and may terminate the account and delete associated personal information when appropriate, subject to applicable legal and security-retention requirements.

3. Accounts and Account Security

You agree to provide accurate account information, maintain only accounts you are authorized to use, and keep your login credentials secure. You are responsible for activity occurring through your account except to the extent caused by Marker North or prohibited by applicable law.

Passwords are processed using secure password hashing. Marker North does not store passwords in readable form and Marker North administrators cannot view your password. You must notify Marker North promptly if you suspect unauthorized access, credential theft, or another account-security issue.

Driver IDs, membership dates, account ownership records, and other system-issued identifiers may not be altered by users. Display names and public profile fields remain subject to Marker North moderation and privacy controls.

4. The Marker North Service

Marker North is a trucking-simulation companion platform designed to connect eligible simulator activity with driver histories, statistics, maps, achievements, rankings, community discovery, and related tools. Features may be experimental, incomplete, modified, unavailable, or removed, particularly during pre-alpha, alpha, beta, testing, maintenance, and early-access periods.

Marker North may correct inaccurate records, exclude ineligible or unverifiable activity, and modify scoring, rankings, achievements, formulas, or feature rules to preserve fairness, security, and platform integrity. Statistics, rankings, estimates, grades, and achievements are platform features—not official records, financial statements, employment records, or guarantees of performance.

5. CAPS, the Client, and Telemetry

CAPS and the Marker North Client may collect and transmit eligible game telemetry to provide requested features. Depending on available game data and your settings, this may include driver-session status, truck and trailer information, cargo and job information, routes, cities, road information, coordinates, heading, speed, gear, fuel, engine state, damage, distance, time, and related operational data.

You control supported public visibility options through Marker North settings. Privacy settings affect what Marker North displays; they do not change privacy settings maintained separately by the game, Steam, Discord, Twitch, or another third-party service.

The Marker North Client is intended to read supported telemetry and communicate with Marker North. It is not intended to modify game files, automate gameplay, bypass game protections, or provide an unfair gameplay advantage. You remain responsible for complying with the terms and rules of the game and any server, convoy, modification, or third-party service you use.

If you install the Marker North Client, CAPS, a telemetry plugin, or another Marker North component, you are responsible for confirming that your computer, operating system, game version, modifications, security software, permissions, and configuration are compatible. Before installation or updating, you should maintain appropriate backups of files, settings, exports, and other information important to you. Installation, updating, configuration, and use are undertaken at your own risk, subject to rights and remedies that applicable law does not permit these Terms to exclude.

To connect American Truck Simulator, Euro Truck Simulator 2, downloadable content, or another supported game product to Marker North—or to use a Marker North tool that reads a local game installation—you represent that you possess a valid, lawfully acquired license for the applicable product and any required downloadable content. Marker North does not sell, provide, unlock, activate, or grant a license to those products and does not authorize piracy. The Service is not intended to circumvent digital-rights management, ownership verification, license validation, access controls, security protections, or paid-content requirements. This requirement does not prevent a person who does not own a supported game from viewing portions of the Service that Marker North makes publicly available.

6. Acceptable Use

You may not use or attempt to use the Service to:

  • Break any applicable law or infringe another person’s rights;
  • Harass, threaten, exploit, stalk, impersonate, defraud, or endanger anyone;
  • Promote hatred or violence against a protected person or group;
  • Upload, transmit, solicit, or facilitate illegal sexual material, child sexual abuse material, or sexual exploitation;
  • Publish pornography, graphic sexual material, or content unsuitable for the Service;
  • Expose another person’s private information without authorization;
  • Distribute malware, attack systems, evade security, scrape without authorization, or gain unauthorized access;
  • Reverse engineer, interfere with, overload, or disrupt the Service except where a restriction is prohibited by law;
  • Manipulate or falsify telemetry, trips, mileage, jobs, fuel data, damage, statistics, achievements, rankings, or identity information;
  • Sell, transfer, rent, or share an account without Marker North’s written authorization;
  • Use automated means to create accounts, generate fraudulent activity, or abuse platform functionality; or
  • Help another person perform any prohibited activity.

7. Community Features and User Information

Marker North may display privacy-controlled profiles, activity, statistics, rankings, achievements, public map presence, driving groups, connected-service status, and other community information. You are responsible for information you choose to make public and for ensuring you have the right to provide it.

Marker North does not provide general driver-to-driver private messaging. Optional Discord contact or other connected-service features are controlled separately and may direct users to third-party services governed by their own rules and moderation systems.

You grant Marker North a limited, nonexclusive, worldwide, royalty-free license to host, process, reproduce, format, and display information you submit only as reasonably necessary to operate, secure, and improve the Service and honor your selected visibility settings. You retain any ownership rights you otherwise have.

8. Games and Third-Party Services

Marker North may integrate with or link to third-party games and services such as Steam, Discord, Twitch, mapping technology, hosting providers, email providers, payment processors, and support tools. Those services are independently operated and governed by their own terms and privacy policies. Marker North is not responsible for third-party services, outages, content, security, decisions, or changes.

American Truck Simulator, Euro Truck Simulator 2, SCS Software, Steam, Discord, Twitch, and other names and trademarks belong to their respective owners. Unless expressly stated otherwise, Marker North is not endorsed by, sponsored by, or affiliated with those owners.

Marker North software and map-generation systems may include, incorporate, modify, or interact with properly licensed third-party and open-source software, including SCS telemetry technology, software derived from the RenCloud SCS SDK plugin, software derived from the Unicor-p/ts-map project and its upstream project, and other libraries. Those components remain subject to their applicable licenses, copyright notices, warranty disclaimers, and attribution requirements. Required notices and license texts will be made available through Marker North’s Third-Party Notices and, when applicable, with distributed software. Their inclusion does not imply that their authors, maintainers, or copyright holders sponsor, endorse, or warrant Marker North.

Marker North does not grant ownership of or a license to SCS Software game files, archives, textures, models, downloadable content, or other third-party materials. Marker North map tools are intended to produce functional cartographic information from lawfully accessed game installations. Marker North does not authorize the redistribution of protected game archives or paid downloadable content.

9. Plans, Trials, Payments, and Future Features

Marker North intends for core driver features identified as free to remain free. Advanced statistics, VTC analytics, GPS, hours-of-service tools, professional features, or other future capabilities may be offered through paid plans.

Before any purchase, Marker North will display the applicable price, billing period, included features, renewal terms, cancellation method, and material limitations. Additional subscription, trial, cancellation, and refund terms presented at purchase will become part of these Terms. Payment-card information may be processed by a third-party payment processor rather than stored by Marker North.

Preview access, tester access, complimentary access, trials, promotions, and future features may be modified or withdrawn unless Marker North expressly promises otherwise in writing. Nothing in these Terms limits nonwaivable consumer rights.

10. Marker North Intellectual Property

The Service—including Marker North and CAPS names, logos, designs, software, source code, interfaces, original graphics, databases, scoring systems, documentation, and other original materials—is owned by Marker North or its licensors and protected by applicable intellectual-property laws.

Third-party and open-source components, game data, names, trademarks, and other materials are not claimed as original Marker North property merely because they are used by, referenced by, or interoperable with the Service. Ownership and license rights in those materials remain with their respective owners and licensors.

Subject to these Terms, Marker North grants you a limited, personal, revocable, nonexclusive, nontransferable license to access and use the Service for its intended purpose. No ownership is transferred to you. You may not commercially exploit, sublicense, resell, copy, or create derivative services from Marker North materials except with written permission or where applicable law expressly permits it.

Except with Marker North's prior written permission or where nonwaivable law expressly permits it, you may not sell, rent, lease, license, sublicense, distribute, redistribute, publish, mirror, transfer, broadcast, make available, reproduce, copy, exploit, or commercially use any Marker North software, CAPS client or installer, branding, content, documentation, data, services, access, or related materials. You also may not remove copyright or trademark notices, bypass access restrictions, or misrepresent an affiliation with Marker North. This restriction applies to materials owned or controlled by Marker North and, where applicable, its affiliates, licensors, and authorized partners; it does not limit rights granted under an applicable third-party or open-source license.

If you voluntarily submit an idea, suggestion, correction, feature request, design, or other feedback about Marker North, you agree that Marker North may use, adapt, evaluate, develop, publish, or incorporate that feedback without restriction or compensation to you. You should not submit feedback that you do not have the right to provide or that contains another person’s confidential information. Personal information included with feedback remains subject to the Privacy Policy.

If you believe material available through the Service infringes your copyright, trademark, or another intellectual-property right, you may submit a good-faith report through the Marker North Support Center. The report should identify the protected work or right, identify the material and its location in the Service, provide your contact information, explain the basis of your claim, and confirm that the information supplied is accurate and that you are the rights owner or are authorized to act for the owner. Marker North may remove or restrict material while reviewing a report and may request additional information. A dedicated legal or copyright contact will be published before public release.

11. Account Suspension and Termination

Marker North reserves the right, to the fullest extent permitted by applicable law, to suspend, restrict, disable, or terminate any account or access to any part of the Service at any time, with or without prior notice, when Marker North reasonably determines that doing so is necessary or appropriate.

Reasons may include, but are not limited to:

  • Violation of these Terms, the Privacy Policy, or another published Marker North policy;
  • Fraudulent, unlawful, abusive, threatening, deceptive, exploitative, or harmful activity;
  • Providing false account, eligibility, identity, or age information;
  • Security attacks, unauthorized access, interference, or misuse of the Service;
  • Manipulation or falsification of telemetry, trips, statistics, achievements, or rankings;
  • Conduct creating legal, regulatory, security, operational, reputational, or safety risk;
  • Extended inactivity, discontinuation of the Service, or legitimate technical or business reasons; or
  • Any other lawful reason Marker North reasonably believes necessary to protect the Service, its community, its rights, or the rights and safety of others.

When circumstances reasonably permit, Marker North may provide notice or an opportunity to appeal. Marker North may act immediately without prior notice when it believes urgent action is necessary to protect users, preserve evidence, prevent harm, comply with law or legal process, or protect the security and integrity of the Service.

You may stop using the Service and request account deletion through available account or support controls. Certain information may be retained where reasonably necessary for security, fraud prevention, dispute resolution, legal compliance, or enforcement, as explained in the Privacy Policy. Treatment of paid periods, balances, or refunds remains subject to applicable law and the applicable subscription or refund policy.

12. Service Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” MARKER NORTH DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ERROR-FREE OPERATION.

Marker North does not guarantee uninterrupted operation, permanent availability of any feature, compatibility with every game version or modification, preservation of every record, or accuracy of telemetry supplied by a game, plugin, network, user device, or third party. You should maintain copies of exports or information that are important to you.

Marker North may interrupt, restrict, or suspend all or part of the Service for maintenance, security, repairs, updates, legal compliance, capacity management, or other operational reasons. To the maximum extent permitted by applicable law, Marker North is not responsible for delay, interruption, or failure caused by circumstances beyond its reasonable control, including internet or hosting failures, utility outages, telecommunications failures, denial-of-service attacks, third-party platform or game outages, labor disputes, natural disasters, public emergencies, governmental actions, or similar events. Nothing in this paragraph limits a right or remedy that applicable law does not permit these Terms to exclude.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARKER NORTH DOES NOT WARRANT THAT INSTALLING, UPDATING, CONFIGURING, OR USING THE CLIENT, CAPS, TELEMETRY PLUGINS, MAP TOOLS, OR OTHER SOFTWARE WILL BE COMPATIBLE WITH EVERY COMPUTER OR CONFIGURATION OR WILL BE FREE FROM INTERRUPTION, CONFLICT, DATA LOSS, FILE CORRUPTION, CONFIGURATION CHANGE, OR OTHER ADVERSE EFFECT. THIRD-PARTY AND OPEN-SOURCE COMPONENTS MAY ALSO BE PROVIDED SUBJECT TO SEPARATE “AS IS” DISCLAIMERS IN THEIR APPLICABLE LICENSES.

Marker North is a simulation companion service. It is not a substitute for real-world navigation, dispatch, vehicle diagnostics, employment records, tax advice, safety systems, electronic logging devices, or legally compliant hours-of-service records.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARKER NORTH AND ITS OWNERS, OPERATORS, CONTRIBUTORS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, PROFITS, GOODWILL, REPUTATION, OR BUSINESS; OR DAMAGES ARISING FROM THIRD-PARTY SERVICES, GAME CHANGES, UNAUTHORIZED ACCESS, SERVICE INTERRUPTION, OR RELIANCE ON SIMULATION DATA.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE FOREGOING LIMITATIONS ALSO APPLY TO CLAIMS INVOLVING DAMAGE TO OR LOSS OF USE OF A COMPUTER, STORAGE DEVICE, OPERATING SYSTEM, GAME INSTALLATION, MODIFICATION, CONFIGURATION, FILE, SAVE, PROFILE, EXPORT, OR OTHER DATA ARISING FROM INSTALLATION, UPDATING, CONFIGURATION, OR USE OF THE SERVICE OR ITS SOFTWARE COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKER NORTH’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID MARKER NORTH FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR 100 U.S. DOLLARS. These limitations do not apply where prohibited by law or to liability that cannot legally be limited or excluded.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Marker North and its owners, operators, contributors, contractors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable legal expenses arising from your unlawful use of the Service, your material violation of these Terms, your infringement of another person’s rights, or information you submit without authorization. This obligation does not apply to the extent a claim was caused by Marker North’s own unlawful conduct.

15. Changes to the Service or These Terms

Marker North may update the Service and these Terms as the platform, law, security needs, and business model evolve. The effective date and version will identify the current Terms. Material changes will be communicated through reasonable methods such as the Service, account inbox, or email.

When required, Marker North will request renewed acceptance and record the applicable policy version and acceptance time. Changes will not be applied retroactively in a manner prohibited by law. Continued use after an update becomes effective constitutes acceptance where legally permitted; otherwise, you must stop using the Service.

Where legally permitted, you agree that Marker North may provide account, security, transaction, policy, support, and other Service-related notices electronically, including through the email address associated with your account, the Marker North Inbox, an in-Service notification, or a notice displayed on the website. You are responsible for maintaining an accurate email address and reviewing notices delivered through the Service. Electronic delivery does not replace any different form of notice required by applicable law.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles, except where applicable law requires otherwise. Any legal proceeding that is not subject to another legally required forum will be brought in a state or federal court with appropriate jurisdiction in Florida, and you and Marker North consent to that court’s jurisdiction and venue.

Before filing a claim, you and Marker North agree to make a good-faith effort to resolve the dispute informally through the Marker North Support Center, unless immediate relief is needed or applicable law permits otherwise. Nothing in these Terms prevents either party from seeking appropriate injunctive relief or using an eligible small-claims procedure.

Laws protecting users in their place of residence may still apply regardless of this governing-law provision. Nothing in these Terms waives a right that cannot lawfully be waived.

17. General Terms

These Terms, the Privacy Policy, and any additional terms presented for a particular feature constitute the agreement regarding the Service. If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective.

Marker North’s failure to enforce a provision is not a waiver. You may not assign your account or these Terms without written permission. Marker North may assign these Terms as part of a reorganization, financing, merger, acquisition, sale, or transfer of the Service, subject to applicable law and the Privacy Policy.

Section headings are provided for readability. Provisions that by their nature should survive termination—including intellectual-property protections, disclaimers, liability limitations, indemnification, dispute provisions, and accrued obligations—will survive termination.

19. Acknowledgments

Marker North was built with careful testing, many long development sessions, and the watchful supervision of Shadow, our honorary Quality Assurance Cat.

Shadow remained an important presence throughout development—occasionally supervising from beside the computer, occasionally guarding the ethernet cable, and occasionally sleeping on the job. We gratefully recognize his contribution to the journey that became Marker North.
