Privacy is a core Marker North setting

Marker North collects the information needed to operate your account, CAPS connection, trips, statistics, achievements, rankings, maps, community features, security, and support. You control which eligible profile and driving details other people can see.

1. Scope and Who Controls Your Information

This Privacy Policy explains how Marker North collects, uses, stores, shares, and protects information when you use the Marker North website, accounts, driver portal, desktop client, Connected Autonomous Platform System (“CAPS”), APIs, maps, support tools, exports, and related services (collectively, the “Service”).

Marker North is an independently operated, United States-based platform and controls personal information processed for the Service. Privacy questions and requests may be sent to [email protected]. Third-party services may independently control information they process under their own policies.

2. Information You Provide

Depending on the features you use, you may provide:

  • an email address, display name, password, and confirmation that you are at least 18;
  • acceptance records for the Terms of Service and this Privacy Policy;
  • profile details, avatar, preferences, visibility choices, and account settings;
  • support requests, attachments, replies, and other information you send to Marker North;
  • information included in exports, reports, or other actions you request; and
  • billing and subscription information if paid features are introduced.

Marker North stores passwords using secure password hashing. Passwords are not stored in readable form and cannot be viewed by Marker North administrators. If paid features are introduced, payment-card details will be handled by an authorized payment provider rather than stored directly by Marker North unless this Policy is updated to say otherwise.

3. Steam, Discord, Twitch, and Connected Accounts

If you register with or connect a third-party account, Marker North may receive the information you authorize that provider to share, such as a provider account identifier, display name, avatar, account status, or public profile information. Marker North does not receive your Steam, Discord, or Twitch password.

Steam may be used to identify a game account and help verify trip ownership. Discord may be used as an optional, privacy-controlled contact method. Twitch may be used to display streaming status if you choose to connect and publicly enable it. Connecting an account does not automatically make it public. Disconnecting stops future access through that connection, but information already needed for security, verification, or legal records may remain subject to the retention rules below.

4. CAPS and Game Telemetry

When you install and run the Marker North Client, CAPS reads eligible American Truck Simulator telemetry through the SCS Telemetry SDK and sends it to Marker North. The Client is designed to read telemetry and does not need your game password.

Telemetry may include:

  • driver session, online status, game state, and telemetry timestamps;
  • truck make and model, speed, gear, RPM, engine state, cruise control, odometer, and damage;
  • fuel level, capacity, percentage, usage, refueling, range, and calculated fuel economy;
  • position coordinates, heading, current city, road, company, route, and navigation distance;
  • cargo, mass, origin, destination, job income, remaining distance, and remaining time;
  • trailer attachment and damage information; and
  • trip distance, duration, events, completion, performance, and derived scores or statistics.

Telemetry is used to create verified trip history, maps, statistics, achievements, rankings, records, community totals, diagnostics, and related Service features. Stopping the Client or disconnecting CAPS stops new telemetry transmission, but previously processed information may remain under this Policy.

5. Technical, Device, and Security Information

Marker North may automatically collect IP address, browser and device type, operating-system information, Client and game versions, connection status, API request information, sign-in and session timestamps, error and diagnostic data, and security or audit events. This information is used to operate the Service, prevent abuse, investigate incidents, troubleshoot CAPS, and protect accounts and infrastructure.

6. How Marker North Uses Information

Marker North uses information to:

  • create, authenticate, secure, and support your account;
  • operate CAPS, receive telemetry, and generate trips and reports;
  • calculate statistics, fuel efficiency, achievements, rankings, and community totals;
  • display information according to your privacy and visibility settings;
  • provide maps, exports, notifications, updates, diagnostics, and support;
  • detect fraud, tampering, duplicate activity, abuse, and security threats;
  • maintain, analyze, and improve reliability and feature performance;
  • enforce the Terms of Service and protect users, Marker North, and the public; and
  • comply with applicable law and respond to valid legal requests.

Marker North may create statistics from information that has been aggregated or de-identified so it no longer reasonably identifies a person. Such information may be used to measure the platform, preserve historical totals, and improve the Service.

7. Privacy Settings, Public Visibility, and Community

Driver settings may let you control whether eligible information—such as your display name, online status, truck, cargo, speed, trip history, statistics, achievements, connected-account status, and location—is public, visible only to drivers, shown as a nearby area, or hidden. Exact options may differ by feature.

Visibility is not the same as collection

Hiding information prevents or limits its display to other users or public visitors. CAPS may still need to collect and process that information to verify trips, calculate private statistics, secure the Service, and provide features you use.

Information you choose to make public may be viewed, copied, or shared by other people outside Marker North’s control. Marker North does not provide general private driver-to-driver messaging. Optional conversations through Discord are governed by Discord and by the privacy choices you make there.

8. Legal Bases for Processing

Where applicable law requires a legal basis, Marker North processes information as necessary to perform its agreement with you; based on legitimate interests such as security, fraud prevention, support, and Service improvement; to comply with legal obligations; or with your consent when consent is the appropriate basis. You may withdraw consent for future processing where consent applies, without affecting processing already completed lawfully.

9. When Information Is Shared

Marker North may share limited information:

  • with hosting, database, email, security, support, authentication, and other service providers;
  • with Steam, Discord, Twitch, SCS Software, or another provider when you connect or use that service;
  • with payment processors if paid subscriptions or purchases are introduced;
  • with other users or the public when you enable visibility or request a shareable report;
  • to comply with a subpoena, court order, law, or other valid legal process;
  • to investigate abuse, fraud, threats, safety issues, or violations of the Terms; or
  • as part of a merger, financing, reorganization, acquisition, or transfer of the Service.

Providers are permitted to process information only for authorized purposes and subject to applicable contractual and legal protections. Their independent services remain governed by their own privacy policies.

Named Service Providers and Components

Marker North currently uses the following providers and components in operating the Service:

  • Cloudflare for website delivery, security, network services, and private R2 object storage used for Marker North database recovery backups. Cloudflare may process IP address and browser-request information in providing its network services;
  • IONOS for VPS hosting, infrastructure, and server-recovery backups used to operate Marker North;
  • Google for optional Google account sign-in and Google Workspace for Marker North email communications;
  • Discord for optional Discord account sign-in and support-ticket communication when you choose to use Discord;
  • RenCloud SCS SDK Plugin and TS-Map as software components used for telemetry and server-side map generation. Their authors do not receive your Marker North information through those components.

10. No Sale of Personal Information or Targeted Advertising

Marker North does not sell personal information, does not sell raw telemetry, and does not use personal information for cross-context behavioral or targeted advertising. If Marker North’s practices change, this Policy and any legally required controls or consent notices will be updated before the new practice begins.

11. Retention, Account Deletion, and De-Identified Data

Marker North retains personal information only for as long as reasonably necessary for the purposes described here, including maintaining an active account, providing requested features, preserving security and audit records, resolving disputes, enforcing agreements, and meeting legal obligations. Different categories may have different retention periods.

Minimum retention baseline: Marker North generally retains account, profile, device, technical, telemetry, trip, support, and security-audit information for at least three years from collection or account closure, whichever is later. Marker North may retain information longer where reasonably necessary for security, fraud prevention, legal compliance, dispute resolution, or the establishment, exercise, or defense of legal claims.

Backup schedule: As currently configured, Marker North maintains IONOS server-recovery backups with daily incremental copies retained for up to 28 days and weekly full copies retained for up to four weeks. Marker North also maintains private Cloudflare R2 database-recovery copies retained for up to 35 days. Backup copies may include the same categories of information held in the affected production systems and are retained solely for security, operational recovery, and continuity purposes.

Marker North may change its backup schedule as systems and security needs evolve. If a material change affects how long personal information remains in backup copies, Marker North will update this Policy before or when the change takes effect, as applicable.

When you request account deletion, Marker North will delete or de-identify account and profile information as required by applicable law. Some information may be retained temporarily in backups or longer where necessary for fraud prevention, security, legal compliance, transaction records, dispute resolution, or the establishment or defense of legal claims.

Trips, fuel measurements, mileage, performance data, achievements, rankings, and similar telemetry-derived records may be deleted, separated from your identity, or converted into aggregated or de-identified statistics. Properly de-identified or aggregated information that no longer reasonably identifies you may be retained for historical integrity, community totals, research, analytics, and Service improvement.

12. Information Security

Marker North uses reasonable administrative, technical, and organizational safeguards designed to protect information, including password hashing, access controls, authentication measures, secure communications, audit records, and restricted administrative access. No system or transmission method can be guaranteed completely secure. You are responsible for protecting your credentials and promptly reporting suspected unauthorized access.

Security Incidents and Breach Notification

If Marker North discovers or reasonably suspects unauthorized access to personal information, Marker North will investigate the incident, take reasonable steps to contain it and reduce potential harm, preserve appropriate records, and provide notices to affected individuals, government authorities, or other parties when required by applicable law. A notice may describe the nature of the incident, the information involved, actions Marker North has taken, and steps affected individuals may take to protect themselves.

Marker North will acknowledge, respond to, and cooperate with law-enforcement agencies, regulators, courts, and other governmental authorities when required by applicable law or valid legal process. Marker North may preserve or disclose relevant information when legally required to comply with a subpoena, court order, warrant, statutory reporting duty, or other lawful request; investigate or prevent fraud, abuse, or threats; protect the rights, property, or safety of users, Marker North, or the public; or establish, exercise, or defend legal claims.

Marker North will evaluate requests for information and disclose only information reasonably necessary to satisfy the applicable legal obligation, unless the law prohibits notice or requires a broader response. Although Marker North uses safeguards designed to protect information, Marker North cannot guarantee that unauthorized third parties will never defeat those safeguards. Nothing in this Policy limits any responsibility or right that cannot lawfully be limited.

13. Cookies and Local Storage

Marker North may use essential cookies, browser local storage, or session storage to keep you signed in, protect sessions, remember preferences, operate forms, and provide security. If nonessential analytics, advertising, or similar tracking is introduced, Marker North will update this Policy and provide notice, consent, or opt-out controls where required.

Current essential cookies include .MarkerNorth.Authentication, which maintains a signed-in session, and .MarkerNorth.ExternalAuthentication, a short-lived cookie used only while completing Google or Discord sign-in. These cookies are HTTP-only. Marker North also uses browser local storage for limited interface preferences, such as map-layer and dashboard-widget choices. Marker North does not presently use its own advertising or analytics cookies.

14. Your Choices and Privacy Rights

Subject to applicable law and verification of your identity, you may be able to:

  • access, correct, or update account and profile information;
  • change visibility, notification, connected-account, and CAPS settings;
  • request a portable export of eligible information;
  • request deletion of your account and eligible personal information;
  • object to or restrict certain processing where the law provides that right;
  • withdraw consent where processing depends on consent; and
  • appeal a denied privacy request where applicable law requires an appeal process.

Marker North may ask for information necessary to verify a request and may deny or limit a request where permitted by law. Authorized agents must provide proof of authority. Marker North will not unlawfully discriminate against you for exercising a privacy right.

15. United States State and International Rights

Depending on where you live and whether a particular law applies to Marker North, you may have additional privacy rights under United States state law or laws such as the European Union or United Kingdom GDPR. Marker North will respond to valid requests as required by applicable law.

Marker North is operated from the United States. Information may be processed in the United States and other locations where authorized providers operate. Where required, Marker North will use lawful transfer protections. You may also have the right to complain to your local privacy or data-protection authority.

16. Adults-Only Service

Marker North accounts are intended only for people who are at least 18 years old. Marker North does not knowingly collect personal information from anyone under 18. If Marker North learns that an underage person created an account, it may suspend the account and delete associated personal information, subject to legal and security retention requirements. Concerns may be reported through the Support Center.

17. Changes to This Policy

Marker North may update this Privacy Policy as the Service, providers, legal requirements, or data practices change. The effective date and version will be updated. Material changes may be announced through the website, inbox, email, or another appropriate notice. Where required, Marker North will request renewed consent before applying a material change.
